These Terms of Service ("Terms") govern your use of the Wize Sleep mobile application ("App") operated by NextSense Inc. ("we," "us," or "our"). By using the App, you agree to these Terms.
Use of the App
Wize Sleep provides sleep analysis and scoring based on data from your wearable devices via Apple Health. The App is intended for informational and wellness purposes only.
Not Medical Advice
Wize Sleep is not a medical device and does not provide medical advice, diagnosis, or treatment. The sleep scores, benchmarks, and insights provided by the App are for general wellness information only. Always consult a qualified healthcare provider for medical concerns, including sleep disorders.
Account
You may need to create an account to use certain features. You are responsible for maintaining the security of your account credentials and for all activity under your account.
Beta Program
Wize Sleep is currently in beta via Apple TestFlight. The App is provided "as is" during the beta period. Features may change, and the App may contain bugs. We appreciate your feedback to help improve the experience.
Intellectual Property
All content, design, code, and scoring algorithms in the App are owned by NextSense Inc. and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
Limitation of Liability
To the maximum extent permitted by law, NextSense Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App (if any).
Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may stop using the App at any time.
Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
